  Summary: The Munich section of the Central Division rejected Fives ECL's preliminary objection to jurisdiction in Reel International's revocation action against EP 1 740 740, holding that Rule 19.1 RdP's list of preliminary-objection grounds is exhaustive and does not extend to lack of legal interest to act or res judicata. It also rejected Fives ECL's alternative requests for an early ruling on those defenses (R. 361/362 RdP) and for an early hearing, deferring both to the merits decision, and exempted Reel International from translating English-language exhibits. Costs of the preliminary objection will be decided together with the decision on the merits.
