Zusammenfassung: The Paris Local Division found that Orange failed to prove that HMD's Android smartphones and tablets infringe EP 2 345 029 (audio decoding), because the accused USAC/FAC decoding mechanism transmits additional transition information, which falls outside the scope of claims 1 and 6 as the patent teaches avoiding such additional data transmission. The infringement action was dismissed. Because HMD's counterclaim for revocation (UPC_CFI_713/2025) was made conditional on a finding of infringement, and infringement was not found, the Court did not decide the counterclaim, the exhaustion objection, the FRAND defence, or proportionality. Orange was ordered to bear the costs of the proceedings under an agreement between the parties, so no separate costs decision was required.

Zusammenfassung: The Judge-Rapporteur allowed Orange SA to file a supplementary written response on the FRAND defence (pages 14-86 of its 17 March 2026 application) in the interests of fairness and adversarial proceedings. HMD's subsidiary request to respond further to the FRAND defence was denied. No substantive ruling on infringement or validity was made.

A solution requiring the transmission of any additional (corrective) data to manage the transition between transform-based (FD) decoding and CELP decoding goes against the teaching of the patent and is not encompassed within the scope of claims 1 and 6, even though paragraph [0148] refers to transmitting additional transform-coded data.
BeklagterRechtsgrundlage: claim construction of EP2345029 claims 1 and 6, read in light of the descriptionIt was permissible for HMD to make its counterclaim for revocation conditional on a finding of infringement, so that the Court examines infringement before validity
BeklagterRechtsgrundlage: established UPC case law on conditional counterclaims for revocation (e.g. UPC_CFI_180/2025, UPC_CFI_210/2025, UPC_CFI_414/2024, UPC_CFI_628/2024, UPC_CFI_125/2025; confirmed by CoA in UPC-CoA-40/2026, Emboline v AorticLab)
The HMD smartphones and tablets running Android 9 or higher necessarily perform the claimed transition from frequency-domain (transform-based) decoding to ACELP decoding, in particular features B, C2 and C3 of claims 1 and 6, via the USAC standard's FAC mechanism
KlägerRechtsgrundlage: infringement of EP2345029 claims 1 and 6
