UPC CoA 100/2026

The Court of Appeal permitted the withdrawal of appeals UPC-CoA-100/2026, UPC-CoA-101/2026 and UPC-CoA-102/2026 following a settlement between Shenzhen Transsion (appellants) and Ericsson (respondent), and declared the proceedings closed. Each party is to bear its own costs, and Shenzhen Transsion is to be reimbursed 50% of the appeal fees (EUR 2,000) pursuant to R. 370.9(b) RoP.

On Shenzhen Transsion's appeals against the Hague Local Division's confidentiality-club order of 27 May 2026 in the Ericsson FRAND proceedings, the standing judge held that where the Court of First Instance does not decide a request for leave to appeal within the 15-day period of R. 220.2 RoP, leave is deemed refused and the CFI cannot grant it later, so its grant of 15 June 2026 was ineffective. Observing that the request filed on 10 June 2026 might nonetheless be read as including a request for discretionary review under R. 220.3 RoP, the Court invited the parties to comment on that point within five calendar days.
