Zusammenfassung: The Hamburg Local Division granted Cybex GmbH's application for preliminary measures against NUNA International B.V. and Allison GmbH under EP 4 242 056 B1, prohibiting the combined use/marketing of a car-seat element together with the 'base curv' child-seat base system without the patent holder's consent, backed by recurring penalty payments and information/disclosure obligations. Cybex's auxiliary requests, filed only in the reply, were not admitted, and its remaining applications were otherwise dismissed. The respondents must bear 90% of the costs and provisionally reimburse EUR 56,000, with the value in dispute set at EUR 550,000.

Relying, as the main request, on a claim set narrower than the granted claims (combination of Claims 1 and 2) does not preclude the ordering of preliminary measures.

Auxiliary requests submitted for the first time in the reply, adding a feature not covered in that form by a dependent claim, were not admitted because the defendants would have had only a very short time to prepare their defense, particularly on validity.
