The Court of Appeal addressed the conditions for staying infringement proceedings pending opposition proceedings before the EPO under Art. 33(10) UPCA and R.295(a) RoP. The Court held that a stay may be ordered where a rapid decision by the EPO Opposition Division can be expected, even if an appeal against that decision is likely.
