Accepted arguments
What the court agreed with — by party.
  • The respondent culpably failed to comply with the disclosure obligation (item IV) of the preliminary injunction order of 9 December 2025, justifying imposition of coercive fines at EUR 1,000 per day from 31 March 2026.

    ClaimantLegal basis: R. 354(3) RoP; UPC_CoA_845/2024 (Belkin v. Philips)
  • A prior threat of coercive fine was required before imposition; such threat was issued on 17 March 2026.

    ClaimantLegal basis: R. 354.4 RoP; UPC_CoA_699/2025 (Kodak/Fujifilm)
  • A stepped escalation of the daily fine rate after 30 April 2026 is justified by continued uncooperative conduct.

    ClaimantLegal basis: R. 354(3) RoP; UPC_CoA_845/2024 (Belkin v. Philips)
Rejected arguments
What the court did not agree with — and why.
  • Request for immediate imposition of fines at EUR 1,500 per day (item III of claimant's request) for the period up to 30 April 2026 was rejected, as the prior threat was limited to EUR 1,000 per day; any further escalation requires a new threat.

    ClaimantLegal basis: R. 354.4 RoP; UPC_CoA_699/2025 (Kodak/Fujifilm)
  • Request that the court authorise future increases of the fine on further application (item IV of claimant's request) was rejected, as any further increase of the fine requires a fresh application.

    ClaimantLegal basis: R. 354 RoP
