The Court of Appeal allowed DexCom's withdrawal of its infringement action and Abbott's withdrawal of the counterclaims for revocation, declared the proceedings closed, and ordered reimbursement of 60% of DexCom's court fees; as a result the first instance decision revoking DexCom's patent became ineffective.
