Zusammenfassung: In the appeal against the Hague Local Division's decision of 3 March 2026 dismissing the infringement action and revoking EP 2 437 696, the Court of Appeal judge-rapporteur declined to decide at this stage whether the eleven additional auxiliary requests filed with the statement of grounds were validly introduced under Art. 73(4) UPCA and R. 222.2 RoP, reserving that question for a later stage of the appeal. The respondents' alternative request to have their deadline for a statement of response and cross-appeal fixed at three months from a future admissibility decision was rejected, since the content of the requests is already known to them.
